These Terms and Conditions (“Terms”) govern the use of the payment gateway services (“Services”) provided by HAVIQUE (“Company”), an Indian-based clothing manufacturer. By using the Services, you (“User”) agree to be bound by these Terms. Please read these Terms carefully before proceeding.

1. Eligibility

1.1 The Services are available to individuals who are at least 18 years old and have the legal capacity to enter into binding agreements under Indian law.
1.2 Users must provide accurate, complete, and current information when using the Services.

2. Payment Methods

2.1 HAVIQUE accepts payment through credit cards, debit cards, UPI, net banking, and other online payment methods authorized by Indian financial institutions.
2.2 All payments made using the Services must be in Indian Rupees (INR).
2.3 Users agree to use a valid payment method and authorize the payment gateway to process payments for the order placed.

3. Order Processing and Confirmation

3.1 Upon successful payment, a confirmation will be sent to the User via email or SMS.
3.2 HAVIQUE reserves the right to cancel any order if fraudulent activity or a breach of these Terms is suspected.
3.3 In the case of order cancellation, the User will receive a refund based on the refund policy outlined below.

4. Pricing and Taxes

4.1 Prices listed on the website or mobile application are inclusive of all applicable taxes, unless otherwise stated.
4.2 The Company reserves the right to change prices without prior notice. However, such changes will not affect confirmed orders.

5. Refund and Cancellation Policy

5.1 Users can cancel their order within 24 hours of purchase for a full refund, provided the order has not been shipped.
5.2 Once the order has been shipped, no cancellation is allowed, and the User must follow the return and refund policy.
5.3 Refunds will be processed to the original payment method used by the User, within [7-10] business days of cancellation approval.

6. Shipping and Delivery

6.1 Orders will be processed and shipped within [X] business days. Delivery timelines may vary depending on location and shipping method chosen.
6.2 Users will receive shipping details and tracking information via email or SMS.
6.3 HAVIQUE is not responsible for delays caused by third-party couriers, customs clearance, or any force majeure events.

7. Disputes and Chargebacks

7.1 Users agree to contact HAVIQUE for any disputes regarding payment or transactions before initiating a chargeback request.
7.2 If the User initiates a chargeback request, they must provide a valid reason as per the rules and regulations of their payment provider.
7.3 Fraudulent chargeback requests will lead to termination of the User’s access to the Services and may result in legal action.

8. Liability

8.1 HAVIQUE will not be liable for any loss or damage caused by third-party payment gateway providers.
8.2 Users agree to indemnify and hold HAVIQUE harmless from any claims, losses, or damages arising from misuse of the Services.

9. Data Protection and Privacy

9.1 HAVIQUE values your privacy and ensures the security of your personal and payment information in compliance with Indian laws.
9.2 The Company will not share your payment details with third parties except as required for processing payments.

10. Modification of Terms

10.1 HAVIQUE reserves the right to modify these Terms at any time. Users will be notified of any significant changes through the Company’s website or email.
10.2 Continued use of the Services after changes are made constitutes acceptance of the revised Terms.

11. Governing Law and Jurisdiction

11.1 These Terms shall be governed by and construed in accordance with the laws of India.
11.2 Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Surat.
